1. SERVICE OWNER
Zappiness is a project owned by:

Zappiness operates in production through the domains zappiness.app and app.zappiness.app.
2. PURPOSE OF THE SERVICE
Zappiness is an audiovisual discovery and recommendation service designed to help users decide what movie or series to watch by using their preferences, streaming platforms, filters, history, title states, and interaction signals.
Recommendations are provided for guidance only. Zappiness does not guarantee that content will remain available on a particular platform, that information supplied by third parties will always be current, or that a recommendation will necessarily match a user's preferences.
3. CONDITIONS OF USE
Users agree to use Zappiness lawfully, in good faith, and with respect for the rights of others.
Users may not use the service to:
- attempt to access data, areas, or features without authorization;
- alter, damage, overload, or interfere with the application or its infrastructure;
- automate abusive uses or uses incompatible with the normal operation of the service;
- engage in unlawful activities or activities that infringe the rights of others.
Zappiness may temporarily limit or suspend access when reasonably necessary for technical, security, maintenance, abuse-prevention, or compliance reasons.
4. BETA PHASE
The Beta version is intended to validate and improve Zappiness before its general launch.
During this phase, errors, functional changes, temporary interruptions, visual or technical modifications, and adjustments to the persistence of test data may occur.
During the Beta, Zappiness does not guarantee uninterrupted availability or complete freedom from errors.
5. INTELLECTUAL PROPERTY
The software, architecture, design, visual identity, brand, functional structure, original text, product logic, and other original elements of Zappiness belong to their respective owner or are used with the appropriate authorization.
Access to the service does not transfer any intellectual property rights to the user.
Third-party content, trademarks, images, metadata, and other materials remain subject to the rights and terms of their respective owners.
6. THIRD-PARTY SERVICES, DATA, AND CONTENT
Zappiness uses third-party services that are necessary for certain product functions.
The main providers and sources currently used during the Beta include:
- Google, for OAuth authentication.
- AWS Lightsail, for technical infrastructure and service execution.
- Neon PostgreSQL, as the service's database infrastructure.
- TMDB, as a provider of metadata, images, and other audiovisual information.
- JustWatch, as a source of streaming-platform availability information supplied through TMDb.
TMDB does not receive directly identifying personal information about Zappiness users from Zappiness. Catalog requests are made through the Zappiness server.
This product uses the TMDB API but is not endorsed or certified by TMDB.
The availability of content and external services depends on the relevant third-party providers and may change without notice.
7. EXTERNAL LINKS AND PLATFORMS
Zappiness may display information or access points related to streaming platforms or other external services.
Access to and use of those services are subject to each third party's own terms, availability, and policies.
Zappiness does not control or guarantee the continuity, accuracy, or operation of external services.
8. LIABILITY
Zappiness is provided as an audiovisual discovery and recommendation tool.
To the extent permitted by applicable law, the project owner does not guarantee:
- permanent availability of the service;
- complete absence of errors;
- continuous updating of third-party data;
- availability of a title on a specific platform;
- that a recommendation will subjectively suit a user's preferences.
Users decide for themselves how to use the recommendations and information displayed by Zappiness.
Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited.
9. PRIVACY
The processing of personal information is governed by the Zappiness Privacy Policy.
The Privacy Policy explains, among other matters, the processing of account data, the optional Personal Profile, the Taste Profile, telemetry, aggregated B2B statistics, service providers, retention periods, and user rights.
10. CHANGES TO THE SERVICE AND THIS LEGAL NOTICE
Zappiness may modify the service and this Legal Notice when necessary to reflect technical, functional, legal, or infrastructure changes.
When changes are material, the date of the published version will be updated.
11. GOVERNING LAW AND DISPUTES
This Legal Notice is governed by Spanish law and applicable European Union law.
For users residing in the United States, this choice of law does not waive or limit any rights or protections that cannot lawfully be waived under applicable U.S. federal or state law.
Disputes will be submitted to the courts or other authorities having jurisdiction under the applicable rules, without prejudice to any mandatory rights available to consumers or users.
